Hey there, welcome to Moron Mayhem! We're stoked that you're joining us. But before you start
having
too much fun, there are some official (but still pretty cool) Terms of Service we need to lay
down.
By playing our Game, using our services, or even just poking around, you're saying "Yep, I'm
in." If
you don't agree to these terms, that's ok, but no Game for you. Let's get to it!
1. Acceptance of Terms
By creating an account, logging in, or otherwise accessing or using the Game, you acknowledge that
you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do
not agree to these Terms, you must not access or use the Game.
We may update these Terms from time to time. When we do, we will revise the "Effective Date"
above. Your continued use of the Game after any changes constitutes acceptance of the updated Terms.
If a change materially affects your rights, we will make reasonable efforts to notify you (such as an
in-game notice or email).
2. Account Registration & Eligibility
Okay, time to make your account. We know you're excited, but before you sign up, here's what you
need
to know:
- Be Real: When you sign up, you agree to give us the real
deal –
accurate, honest, up-to-date info. No fake names, or email addresses (trust us, it never
works
out).
- Security: You've gotta keep your login info safe, alright?
Don't share your password with your dog or anyone else for that matter. If something sketchy
happens, let us know.
- Age Requirements: You must be at least 13 years old to
create an account or use the Game. If you are between 13 and 17, you represent that a parent or
legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly collect
personal information from children under 13. If we discover that a user is under 13, we will
promptly delete their account and associated data in compliance with the Children's Online
Privacy Protection Act (COPPA).
3. License to Use the Game
Here's the deal – we own the Game, all its cool stuff, and anything that makes it run. We're
letting
you play it for fun, but don't get any wild ideas about owning it. You get a license to play,
but we
still control the fun.
- Prohibited Uses: Don't try to hack it, don't use cheats,
don't
mess with the Game's code.
- Availability: Stuff happens. The game might go down. Could
be
maintenance, updates, glitches, Mother Nature, or one of our moms accidentally unplugged the
server cord in our basement bedroom. Whatever. Bear with us, and don't hold it against us.
We
are not on the hook for any downtime or disruptions.
4. Intellectual Property
This is where we tell you that everything in the Game belongs to us or our partners – the code,
the
art, the music, the everything. You can enjoy it, but you can't copy it, steal it, or sell it.
Simple, right?
User-Generated Content: If you share stuff in the
Game – like chat, forums, or cool pictures – you're giving us permission to use, tweak, and
share it
with the world.
5. Prohibited Conduct
Don't be a jerk. This is a community of people who just want to have fun, and we'll kick you out
if
you ruin it for others.
- Be Nice: Harassing, bullying, hate speech? Nope.
- Impersonation is a No-Go: Don't pretend to be our staff or
another player. We know the difference.
- Cheating: Using cheats or hacks to get ahead? Absolutely
not.
- Scamming: Trying to steal from other players? We're
watching
you.
- Inappropriate Content: Keep it clean. If it's not, it
doesn't
belong here.
6. In-Game Purchases and Payments
We all know how tempting it is to spend money on shiny new in-game goodies, and we're here for
it.
But, just so you know:
- Virtual Goods: You don't actually own the virtual items you
buy. You're licensing them from us for use within the Game.
- Payment Methods: All payments are processed through Stripe,
our third-party payment processor. We never access or store your card payment information
directly. You'll need to follow their terms as well.
- Electrolyte Kits: Electrolyte Kits are transferable in-game
items. Electrolyte Kits are eligible for a refund if they have not been applied or transferred
to another player, and a refund is requested within 48 hours of purchase, or when required by
applicable law. Once an Electrolyte Kit has been applied or transferred, it is non-refundable.
Transfer logs are final. To request a refund, contact staff in-game or via email at
[email protected].
Please include your player ID and details of your request. We reserve the right to deny refund
requests if abuse of the refund system is identified.
- Refunds (General): Refunds for in-game purchases are not
provided unless the content was never delivered, something was seriously broken, or the item is
eligible under the specific refund terms above. Refunds required by applicable law will always
be honored.
7. Refunds, Deliveries, and Cancellation Rights
Refunds: We generally do not offer refunds for digital goods once
delivered, but if we seriously mess something up (like failing to deliver your purchase), we'll make
it right. Refunds required by applicable law will always be honored. For specific refund eligibility
on Electrolyte Kits, see Section 6 above.
Delays: Sometimes life happens. If there's a delay,
we'll let you know and get things sorted as quickly as possible.
Subscription Cancellation
You may cancel your subscription at any time through your account settings. Here's how it works:
- Cancelling your subscription will prevent it from automatically renewing on the next renewal
date.
- You will retain full access to your subscription benefits until the end of the current billing
period.
- At any time before the renewal date, you may retract your cancellation to allow the subscription
to resume automatically.
- No partial refunds are issued for the remaining time in a billing period after cancellation.
Quick Heads-Up Before You Smash That Buy Button:
By completing a purchase, you agree to receive your digital content
immediately.
For one-time purchases, this means you are waiving your right to a cooling-off
period refund, unless the law in your jurisdiction says otherwise.
For subscriptions, you can cancel at any time through your account settings and
you'll keep access until your current billing period ends.
Make sure you want it before you click "buy." We don't offer refunds for buyer's
remorse on delivered digital goods, but subscriptions can always be cancelled.
8. Suspension and Termination of Accounts
We may suspend, restrict, or permanently terminate your account if you violate these Terms or
engage in conduct that we reasonably believe is harmful to the Game or its community.
- Reasons for Suspension: Illegal or offensive activity,
cheating, abusing others, breaking our Game Rules or Community Guidelines, spamming, selling
accounts or in-game items for real-world value, exploiting bugs, or conduct that is
generally disruptive to the Game or its players.
- Bugs: If you discover a bug or exploit, you must report it
to us promptly and refrain from using it. Exploiting known bugs is grounds for immediate
suspension.
- Scripts: Do not use third-party or self-made scripts,
bots, or tools to interact with the Game in any automated or unauthorized way.
- Notice: Where reasonably practicable, we will notify you
of a suspension or termination and the reason for it. In cases of severe violations (such as
fraud, illegal activity, or imminent harm to other players), we may act immediately without
prior notice.
- Appeals: If your account is suspended or terminated, you
may contact us at [email protected]
to request a review. We will make reasonable efforts to respond within 14 days. Our decision on
appeal is final.
- Effect on Purchases: If your account is terminated for
violating these Terms, you forfeit access to any virtual goods or subscriptions associated with
your account. Refunds are not provided for terminations resulting from Terms violations, except
where required by applicable law.
9. Disclaimer of Warranties
The Game and all related services are provided on an "AS IS" and "AS AVAILABLE"
basis, without warranties of any kind, either express or implied. To the fullest extent permitted
by applicable law, Serious Mayhem LLC disclaims all warranties, including but not limited to
implied warranties of merchantability, fitness for a particular purpose, title, and
non-infringement.
We do not warrant that the Game will be uninterrupted, error-free, secure, or free of
viruses or other harmful components. Your use of the Game is at your own risk.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- No Indirect Damages: Serious Mayhem LLC shall not be liable
for any indirect, incidental, special, consequential, or punitive damages, including but not
limited to loss of profits, data, goodwill, or other intangible losses, arising out of or
related to your use of (or inability to use) the Game.
- Liability Cap: Our total aggregate liability to you for any
and all claims arising out of or relating to these Terms or the Game shall not exceed the
greater of (a) the amounts you have paid to Serious Mayhem LLC in the twelve (12) months
immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars
($100.00 USD).
- Exceptions: Nothing in these Terms excludes or limits
liability that cannot be excluded or limited under applicable law, including liability for
fraud, gross negligence, willful misconduct, or death or personal injury caused by
negligence.
11. Privacy and Data Collection
Your use of the Game is subject to our Privacy Policy, which is equally important. By playing the
Game,
you're agreeing to let us handle your data as we describe there. Don't worry, we're not selling
your
personal info (promise!).
12. Dispute Resolution and Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Florida,
without regard to its conflict of law provisions.
If a dispute arises between you and Serious Mayhem LLC, we'd rather sort it out
without lawyers – we'd both rather be playing the Game. But if it comes to it:
- Informal Resolution: Before filing any formal proceedings,
you agree to contact us at [email protected] and attempt to resolve the dispute
informally for at least 30 days.
- Binding Arbitration: If we can't resolve things informally,
any dispute will be resolved through binding arbitration administered by the American
Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take
place in the State of Florida. Each party will bear its own costs, unless the arbitrator
determines otherwise.
- Opt-Out Right: You may opt out of this arbitration agreement
by sending written notice to [email protected] within thirty (30) days of creating
your account. Your notice must include your username and a clear statement that you decline
the arbitration agreement. If you opt out, disputes will be resolved in the state or federal
courts located in the State of Florida.
- Small Claims Exception: Either party may bring an individual
action in small claims court in the State of Florida if the claim qualifies.
- No Class Actions: You agree to resolve disputes with us on
an individual basis and not as part of any class, consolidated, or representative action.
Note for EU/UK/EEA Users
If you are a consumer residing in the EU, UK, or EEA, the arbitration and class
action waiver provisions above do not override any mandatory consumer protection rights
available to you under the laws of your country of residence. You retain the right to bring
claims in the courts of your country of residence, and nothing in these Terms limits your
statutory rights as a consumer.
13. Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold
harmless Serious Mayhem LLC, its officers, directors, employees, and agents from and against any
claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees)
arising out of or related to: (a) your use of or access to the Game; (b) your violation of these
Terms; (c) your violation of any third-party rights, including intellectual property or privacy
rights; or (d) any content you submit or transmit through the Game.
This indemnification obligation does not apply to EU/UK/EEA consumers where prohibited
by mandatory local law.
14. Force Majeure
Serious Mayhem LLC shall not be liable for any failure or delay in performing our obligations under
these Terms where such failure or delay results from circumstances beyond our reasonable control,
including but not limited to: natural disasters, acts of war or terrorism, pandemics, power outages,
internet or telecommunications failures, government actions, third-party service provider outages,
cyberattacks, or DDoS attacks.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the new version here
and update the effective date. If the changes are material, we will make reasonable efforts to
notify you via in-game notice or email. Your continued use of the Game after the updated Terms
take effect constitutes your acceptance of the changes.
Beta Testers, You Brave Souls
The Game's still in beta, which means it's a beautiful work-in-progress. By
continuing to play, you're cool with the fact that we might change things – including these
Terms – on the fly. If you stick around after the updates drop, that means you accept the
new
rules, no whining.
Also, if you send us feedback, bug finds, or just wild ideas, you agree we can
use
that info however we need – whether it's fixing broken stuff or making the Game better.
We do not use player data or feedback to train AI models. We may use AI-based analysis of
aggregate game statistics to help tune game settings and the in-game economy.

16. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent
jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining
provisions will continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement
between you and Serious Mayhem LLC regarding the Game and supersede all prior agreements,
representations, and understandings, whether written or oral.
18. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior
written consent. Serious Mayhem LLC may assign or transfer these Terms, in whole or in part,
without restriction, including in connection with a merger, acquisition, reorganization, or sale
of assets.
